Merriam Webster defines a “statute of limitations” in relevant part as “a certain time after which rights cannot be enforced by legal action.” In other words, a statute of limitations is a rule requiring that when a victim is inured, they only have a limited time to sue whoever hurt them, and once the time limit is up, the victim can no longer sue. Common statutes of limitations for civil sexual abuse range from 2 to 4 years after the abuse occurred, with the time limit sometimes paused until the survivor turns age 18 or until the survivor discovered or should have discovered that they were sexually abused. But California is different.

On September 19, 2022, California Governor Gavin Newsome signed Assembly Bill 3092 into law, modifying California’s civil sexual abuse statute of limitations by creating a “lookback window.” Now, under CA Civ. Pro. Code § 340.1(q), anyone who was sexually abused in California—no matter how long ago the abuse occurred—can file a civil sexual abuse lawsuit, as long as they file it by December 31, 2022.
